BMI E MJESTATE ACCORDO RINNOVATO

Broadcast Music, Inc. (BMI) (Broadcast Music Inc.) e l’Estate di Michael Jackson hanno annunciato oggi di aver siglato il rinnovo del loro accordo. BMI continuerà a rappresentare i diritti di esecuzione dell’intero catalogo di canzoni di Michael Jackson.

Questo nuovo accordo continua una relazione ininterrotta di ormai 41 anni tra il re del pop e l’organizzazione dei diritti di esibizione, iniziata nel 1979 quando Michael Jackson firmò per la prima volta con BMI. L’Estate del cantante e BMI avevano rinnovato l’ultima volta il loro accordo nel 2014.

“Michael ha firmato per la prima volta con BMI nella fase nascente della sua carriera da solista e BMI non ha mai vacillato nel suo impegno per il suo straordinario talento. Si tratta di un accordo significativo, commisurato alla solida crescita dell’interesse per la sua musica e al suo costante contributo alla cultura “, ha dichiarato John Branca e John McClain, co-esecutori dell’Estate di Michael Jackson.

Da un lato il procedimento contro HBO, dall’altro la disputa (ancora in corso) con Wade Robson e James Safechuck. Quest’ultimo lawsuit potrebbe sbloccarsi in settimana dopo che i due accusatori avevano fatto appello alla decisione del giudice che di fatto aveva (nel 2017) archiviato le loro richieste in particolar modo per i tempi nei quali erano state presentate.


Appellandosi ad una nuova legge della California (che concede più tempo alle presunte vittime di abusi per presentare denuncia) i due potrebbero rientrare nei termini e portare davanti ad un giudice il procedimento.


La Corte d’Appello della California avrebbe parzialmente accolto la richiesta e congelato l’archiviazione in attesa di ri-sentire le parti in causa. Solo allora, sentite le argomentazioni di accusa e difesa, si prenderà una decisione definitiva in merito.

Non è escluso che i giudici possano semplicemente tornare sui loro passi e chiudere così la faccenda. In caso contrario si potrebbe aprire uno scenario processuale finora evitato.

MJEstate Vs HBO – Giudice concede pausa in attesa parere Nono Circuito.

LOS ANGELES (CN) – Un giudice federale ha concesso giovedì alla rete di intrattenimento HBO di sospendere il procedimento arbitrale con l’Estate di Michael Jackson sul documentario “Leaving Neverland” in attesa dell’appello di HBO al Nono Circuito.

Il documentario rende pubbliche le dichiarazioni di due uomini, Wade Robson e James Safechuck, che affermano di essere stati vittime di abusi sessuali da parte di Jackson per diversi anni quando erano bambini e frequentavano il ranch del cantante. L’Estate di Jackson ha fatto causa all’emittente americana HBO per $ 100 milioni di dollari in danni e intende forzare l’arbitrato affermando che il documentario, palesemente “unilaterale” avrebbe violato una clausola di non denigrazione di un vecchio accordo del 1992 tra le parti.

La rete, dal suo punto di vista, ha definito l’accordo di 27 anni fa non valido in tribunale e si è attivata per far archiviare il caso in base allo statuto anti-SLAPP della California, che protegge da denunce, se non vi sia merito, che impediscano il diritto di parola.

In una sentenza dello scorso settembre, il giudice distrettuale americano George Wu aveva negato la richiesta avanzata dall’HBO e aveva inviato la questione all’arbitrato. Subito dopo l’emittente aveva avviato le procedure per cercare di mantenere in stand by la sentenza in attesa del pronunciamento del Nono Circuito chiamato a verificare se un eventuale arbitrato possa o meno danneggiare il loro diritto di libera espressione.

Durante l’ennesima udienza presso il tribunale federale di Los Angeles, il giudice Wu ha quindi concesso ad HBO una pausa e ha auspicando che il Nono Circuito possa far chiarezza in merito alla questione sul Primo Emendamento. Di fatto la cosa non viene trattata come un semplice contratto, ma come qualcosa il cui giudizio possa incidere sulla libertà di espressione.

Per i legali dell’Estate, il tentativo di HBO non sarebbe che l’ennesimo per riuscire a sottrarsi al giudizio per violazione contrattuale e rispondere davanti ad una giuria del proprio comportamento. La questione quindi, è destinata a far parlare di se ancora per molto tempo.

Gli avvocati dell’Estate di Michael Jackson hanno raggiunto un accordo con Sylvester Stewart per l’acquisizione dei diritti di proprietà in US del catalogo delle canzoni di Sly and the Family Stone.

L’intero catalogo include canzoni come “Family Affair”, “Dance To the Music”, “Everybody Is A Star”, “Hot Fun In The Summertime” e “Everyday People”, i loro sei primi successi primi in classifica.

L’Estate continua ad avere, fuori dagli Stati Uniti, il 100% del controllo sul copyrights di tutti i brani del gruppo.

As we are sure you have recently read, tickets for the new Broadway play, “MJ The Musical”, go on sale January 15 with previews starting at the Neil Simon Theatre on July 6, 2020 and the show will premiere on August 13, 2020.

In the meantime, we wanted to say how excited we are about the show. We were excited when we worked with Cirque du Soleil and Jamie King in creating “Michael Jackson THE IMMORTAL World Tour” which went on to become one of the most popular and highest grossing touring shows of all time. And we were equally excited about working again with Cirque de Soleil and Jamie King in creating the “Michael Jackson ONE” show in Las Vegas which just enjoyed its 3,000th performance and remains one of the top selling shows in Las Vegas.

We also were very pleased about the work we did with Spike Lee in creating the “Bad 25” documentary and the documentary “Michael Jackson’s Journey From Motown to Off the Wall.”

We are confident that this new Broadway show will be every bit as good as any show we have had a hand in creating.

Some of you have expressed concern about Lynn Nottage. Let us assure you that Lynn Nottage is a huge Michael Jackson fan. We are always careful about selecting the creative talent who will work on a Michael Jackson project. She was ambushed by the UK tabloid reporter and statements made in casual conversation were taken out of context and have been misconstrued. No show we ever create about Michael will be anything other than truthful and positive, and of course we would never validate the lies and slander that have been perpetrated by Reed, Robson, Safechuck and HBO in what the fans have called a “bullcrapumentary.”

The creative team on this Broadway show is outstanding. Lynn Nottage is the only living playwright who has won two Pulitzer Prizes. Christopher Wheeldon, also a huge Michael Jackson fan, is an acclaimed director and choreographer who won the Tony Award for his work on “An American in Paris” on Broadway.

Having seen rehearsals and read the book we can assure you fans will be very excited. Of course, no one can replace Michael. No one can do what Michael did. There was a reason that Berry Gordy confirmed that Michael is the greatest entertainer who ever lived. However, just as in any movie where a famous historical figure is portrayed, once we enter the playhouse, we have to suspend our disbelief and look forward to seeing a great show paying homage to Michael’s legacy.

You all know that the media has tried very hard to negate Michael’s influence in the world. To use their term, they tried to cancel Michael. The Michael Jackson fans and the Michael Jackson Estate will not allow that to happen. The love of Michael is too strong, it will always be with us. While some media outlets might be hesitant to telecast new Michael Jackson programs in the short term, that will turn around in the long term since everyone wants to see and enjoy Michael and his work. This Broadway show will go a long way toward reminding the world who the King of Pop is. Let’s celebrate it, let’s embrace it and let’s remind everybody that Michael is the greatest of all time.

Raymone Bain torna alla carica: Conferenza e libro

L’ex portavoce di Jackson torna a far parlare di sé dopo le accuse all’Estate del cantante.

In una improvvisata (e bizzarra) conferenza stampa che i tabloid inglesi avevano anticipato come misteriosa nelle ore scorse, Raymone Bain, ex portavoce e partner di Jackson durante le accuse del 2005 si ripresenta con parole di supporto a Jackson, vittima da sempre di persone con pochi scrupoli, e con una nuova fondazione per preservare la “legacy” del re del pop.

In lite con gli avvocati di Jackson alcuni anni or sono e stralciate dal tribunale le sue richieste monetarie in virtù di vecchi accordi con il re del pop, l’ex portavoce torna nel tentativo di ricostruire un’immagine professionale ormai deteriorata.

Dall’altra parte i legali dell’Estate hanno già fatto sapere che la Bain non può in alcun modo parlare a nome del re del pop, ne usare il suo nome e la sua immagine per progetti umanitari ne commerciali… che dire… se il buon giorno si vede dal mattino

Molti si saranno chiesti il perchè di un ritorno sulle scene di Raymone Bain. Beh, ecco spiegato il motivo… un libro pensato anni fa e probabilmente pronto per il prossimo giugno 2020. “Michael Jackson – The Lost Years”, 350 pagine della Strebor Books, porterà sul tavolo la versione dei fatti degli ultimi anni del re del pop, in particolare quelli in cui lei è stata protagonista.

Le due parti si accordano in estremis prima del procedimento

A pochi giorni dall’inizio del procedimento che li vede contrapposti, le parti hanno raggiunto un accordo extra-giudiziale rimasto segreto. L’ex manager di Michael Jackson degli ultimi tempi aveva citato in giudizio l’Estate del cantante già nel 2012 per riuscire ad ottenere compensi mai ricevuti per la sua attività di mediazione per il Ranch di Neverland (evitandone la vendita all’asta) e per i successivi spettacoli del This Is It, pianificati per luglio 2009.

L’Estate, sempre fermamente contraria alle richieste, sembra ora essersi accordata e aver chiuso la faccenda.

Secondo uno statement riportato dal Los Angeles Times:

“The estate of Michael Jackson and Jackson’s former manager, Tohme Tohme, confirm that they have amicably settled a lawsuit that had been underway in the Santa Monica Superior court,”

“Leaving Neverland and The Broadway Musical”

We want to share the below message from the Estate with you all. We know that the community is emotional and exhausted due to all of the attacks on Michael this year, but the Estate wanted to let you know that there will be more actions coming in the following weeks with regard to Leaving Neverland and to also take this opportunity to share with you their perspective on the musical.

STATEMENT FROM THE ESTATE
Last week, John Branca, along with Estate attorneys, were invited to speak at Harvard University. They used the opportunity to raise issues about how Leaving Neverland violates every notion of fairness, while pointing out the gaping lies and holes in its narrative. They also spoke with members of the media, such as Billboard, who were present at some of the events [https://www.billboard.com/…/michael-jackson-estate-hits-bac…]. And you can expect more news from the Estate in the coming weeks.

We also remain focused on long-term projects that we believe will enhance Michael’s legacy moving forward, including the Broadway musical. We can assure you that all those involved in this production, including the Tony Award-winning director, Christopher Wheeldon, and the Pulitzer Prize-winning writer, Lynn Nottage, are devoted MJ fans. That’s why they are committed to bringing this show to Broadway.

If we get this right – which we will – theater audiences will have an even deeper appreciation for Michael’s creative genius, just as they did when they watched This Is It nearly 10 years ago. In fact, we believe this will be as poignant an experience, one that connects the audience to Michael in a way in which he is appreciated both as a person and as an artist. The role for Lynn and Chris, among other things, is of course to entertain, but also to depict the events of Michael’s life and his struggles, both internal and external, that molded him into the person, the artist and the creative genius that this musical celebrates. Simply put, if we didn’t trust Lynn and Chris to do justice to Michael, we would not be working with them.

While we appreciate that, on an emotional level, fans want Lynn and Chris to join the public battle against Leaving Neverland, from an intellectual perspective we believe it is important to understand why Lynn and Chris, to protect the integrity of the musical, should not take a public position at this time one way or another about any issues in Michael’s life. They are biographers who at this stage have been assigned to dispassionately observe their subject’s life and craft their story. Their role is to entertain as well to understand how all of the events and unique personal challenges Michael faced throughout his life shaped him, and molded the character they ultimately present on stage. The story is still a work-in-progress, as they have stated.

As with the two Cirque du Soleil shows and with Spike Lee’s acclaimed documentaries, we are collaborators. We have significant input and say in the final show. But we believe it is important to give all of our creators the freedom to draw upon Michael’s experiences, in this case, to create a well-rounded and in-depth stage character of Michael Jackson. To that end, we have spent a significant amount of time with them sharing our personal knowledge of Michael and our experiences with him as well as introducing them to others who were an integral part of Michael’s life, so they can fully understand the very complicated and talented artist and man that he was.

Michael was constantly judged throughout his life – as he continues to be in death — by those who never bothered to look below the surface. Lynn and Chris will not do that. They are looking at Michael’s life with the goal of helping audiences understand the challenges and pain he faced away from the spotlight and how it shaped a man who shunned society’s norms to such an extent that 10 years after his passing he still commands the world’s attention. We have asked Lynn and Chris not to give us a superficial Michael, but to delve into his humanity, his goodness and his faults along with the conflicts and difficulties he encountered at different stages of his life, so people can understand what fed the fire of this incredibly unique creative genius. With the benefit of having read drafts of the book, being in the room for readings and being present at labs at which we see the musical coming to life, we see and feel Michael’s presence in a way that we do not think would have been possible with anyone less talented than Lynn and Chris.

A musical of the caliber that we are confident is now taking shape will not only pay tribute to and celebrate Michael Jackson’s genius but take audiences on an emotional journey that will surprise fans and non-fans alike as they witness his magical, complex world. Since we all know it is not possible to judge something that you have not experienced yourself, we hope you will all have the opportunity to sit in the theater and experience this musical for yourselves and we look forward to your reactions once you have that opportunity.

Partirà finalmente la prossima settimana il procedimento che vede contrapposti il manager Thome Thome e l’Estate del cantante. Thome, che aveva seguito Michael negli ultimi tempi (dal 2008), aveva citato l’Estate già nel 2010. Nel 2012 le ultime schermaglie che tra qualche giorno arriveranno davanti ad un giudice.

Il manager sostiene di aver diritto al 15% dei compensi ricevuti da Michael in relazione ai 50 concerti previsti all’O2 Arena di Londra e una parte delle royalties del film This Is It realizzato in seguito alla sua prematura scomparsa. News a seguire…
